Obviousness determinations by the Federal Circuit and the district courts before and after KSR
Please join us as Professor Ted Sichelman from the University of San Diego School of Law reports results from the most comprehensive study to-date of obviousness determinations by the Federal Circuit and the district courts before and after the Supreme Court’s landmark decision in KSR v. Teleflex. This study’s results include changes in patentee and accused infringer win rates in the district courts and on appeal, variation in obviousness findings by technology type, and changes in judicial approaches and reasoning after KSR.
