The allocation of incremental profits provided by the use of patented technology is a critical step in a reasonable royalty damages analysis. However, courts have excluded the use of a number of approaches for splitting profits between the patent holder and the alleged infringer under Daubert. In this presentation, you will hear about various profit allocation methodologies that have historically been used, discuss the issues with these models that have been raised by the courts, and explore alternative methodologies.
